Terms of sale
These terms apply to all goods sold by ERCS Ltd ("we", "us", "our") through the online shop.
1. Who we are
ERCS Ltd. Registered office: Strathleven House, Dumbarton G82 3PD, United Kingdom. Email: ercsltd@yahoo.com.
2. Ordering
Placing an order is an offer to buy goods subject to these terms. A contract forms when we send you an order confirmation email. We may decline an order for any reason, in which case we will refund any payment taken.
3. Prices and VAT
Prices shown include VAT at the UK standard rate where applicable and exclude delivery unless stated. We reserve the right to correct obvious pricing errors before shipping.
4. Payment
Payment is taken in full at checkout via Stripe. We do not store your card details. All transactions are in pounds sterling (GBP).
5. Delivery
We aim to despatch stock items within 2 working days and to deliver to UK addresses within 5 working days, but these times are estimates only. Risk passes to you on delivery.
6. Right to cancel (consumer orders)
If you are a consumer buying online, you have the right to cancel within 14 days of receiving your order, without giving a reason, under the Consumer Contracts Regulations 2013. To cancel, email ercsltd@yahoo.com with your order reference. You must return the goods in original condition at your own cost within 14 days of telling us. We will refund the price paid (less any loss of value caused by handling beyond what is necessary) within 14 days of receiving the goods back. Radio equipment that has been programmed to your frequencies, or pre-licensed SIMs and similar bespoke goods, are excluded from the right to cancel once programming has begun.
7. Faulty goods
If goods are faulty on delivery, contact us within 14 days and we will arrange repair, replacement or refund in line with your rights under the Consumer Rights Act 2015.
8. Limitation of liability
Nothing in these terms excludes or limits our liability for death, personal injury, fraud, or any other liability that cannot be excluded by law. Subject to that, our total liability for any order is capped at the price paid for that order.
9. Governing law
This contract is governed by the laws of Scotland and disputes are subject to the non-exclusive jurisdiction of the Scottish courts.
